1. SCOPE AND CONTRACTING PARTIES
The provisions currently in force for orders are available at any time in our online store.
1.1. CONTRACTING PARTIES
This ordering policy is an integral part of all contracts initiated through this online store (www.y-brush.com). These are concluded exclusively by and between Y-Brush (also referred to as "we" or "our") and you, the customer (also "you", "your").
Y-Brush is a brand owned by FasTeesH, headquartered at 14-22 Av. Barthélémy Thimonnier, 69300 Caluire-et-Cuire, France and is registered with the Lyon Commercial Court under number 831 791 850.
Only persons of unlimited legal capacity and who have reached the age of 18 are authorized to place orders on our online store.
1.2. CONSUMERS AND BUSINESS CUSTOMERS
A "business customer" is defined as any natural or legal person who carries out a commercial activity through a transaction. A "consumer" is any natural person who acts for purposes outside his or her trade, business, craft, or profession.
With regard to business customers, this ordering policy will also apply to future business relations, without the need for us to refer back to it. If the business customer adopts contradictory or supplementary conditions, their validity is hereby rejected: they become an integral part of the contract only if we have expressly consented to them.
2. CONCLUSION OF CONTRACT
The contract is concluded only when your order is successfully placed, i.e., at the end of the ordering process when payment has been accepted, and we have charged the payment card you provided. You will receive from us an automatic order confirmation summarizing your order to which you are legally bound.
2.1 REGISTRATION AND ORDER VALIDATION
Your order is made exclusively through a multi-step ordering process.
You can first select products by clicking the "order" button and place them in the shopping cart without commitment.
Goods and quantities in the shopping cart can be adjusted at any time before payment.
By clicking the "Buy" tab, you are redirected to a secure page where you enter your customer information:
Step 1: Entering the email
Step 2: Entering the delivery address, phone number, choice of shipping type
Step 3: Entering bank details. You may also choose a billing address different from the shipping address.
Until Step 4 is validated, the amount will not be charged. You can still review, verify, and if necessary, correct all important and relevant contract information, namely selected goods, quantities, contact details, delivery and payment details...
Step 4: Reading and validating the general terms and conditions of sale before validating the payment
The contract is formed at the moment your order is successfully placed, i.e., when payment has been accepted and we have debited the payment card (Step 4). Any validation of orders implies acceptance of the general terms and conditions of sale.Validation of your order on
y-brush.com constitutes express acceptance of all the GTC.
The receipt of the order will be confirmed by an email from us.
2.2 OTHER TERMS
All products that you can order on our website www.y-brush.com are intended for personal use only. You may not sell the products you receive from us professionally (e.g., as a distributor, reseller, influencer, importer, etc.) without written agreement. Y-Brush (FasTeesH company) reserves the right to cancel your order in case of stock shortage or supply difficulties, or a prior dispute; in this case, the amount of your unprocessed order will be refunded.
3. PAYMENT TERMS
By ordering you agree to pay the price indicated at the time of ordering, upon conclusion of the contract.
Only credit card payments are accepted.
3.1 Subscription Products
In cases where some items in your order are purchased on a subscription basis (for consumables, for example, if you selected "Subscribe" on the product page), payment will be automatically made on the credit card you provided a few days before each shipment and at the frequency you have chosen.
Upon your first order, you will receive a secure link that is intended for you and must never be shared, allowing you to fully manage your subscription without any charges: delivery address, adjustment of products and/or quantities to be delivered, pausing, or definitive stopping, etc.
Each subscription is entered into without a fixed term; it can be canceled at any time by the Customer using this link. Note that if a payment has been made, it cannot be canceled, and the products will be sent. That is, if you stop a subscription between the time a payment has been made automatically and the delivery of the order, the cessation of automatic shipments will take effect from the next billing cycle.
In the event of a payment incident of an automatic installment, reminders will be sent to you by email to update your payment details. As long as these details have not been entered and validated by a payment, no order shipment will take place.
3.2 CREDIT CARDS
By validating your order, your credit card data is transmitted to us. Once we have verified that you are a legitimate cardholder, we will request your credit card issuing company to initiate the payment transaction.
4. DELIVERY AND SERVICE CONDITIONS
With your order, you will receive the products you ordered. Shipping usually takes place within 1 to 2 business days (excluding weekends, public holidays, and unless otherwise stated on the product page and/or website) but may exceptionally take longer and reach up to 7 business days (in case of high demand, temporary stock shortage, etc.). If there is missing information in your delivery address, we will contact you by email or phone, and the shipping date may be delayed until you provide the necessary information. Delivery times depend on the shipping method you choose when entering your banking information and are not guaranteed. When receiving the goods, you will receive an invoice including the VAT and shipping costs. Please note that the photos are not contractual, and the final appearance of the product may be modified.
We only deliver within the shipping route. Delivery will be made to the delivery address specified in your customer information.
Special case: in the case of pre-orders of some of our products, shipping times are clearly indicated on the product sheet as estimated shipping times. They are estimated and may be extended by several months in certain exceptional cases. We will do our best to reduce these lead times as much as possible. In this particular case, once the order has been placed, it cannot be cancelled.
5. RESERVATION OF OWNERSHIP
The goods remain our property until full payment of the order.
If you are late in payment, we are entitled to assert our rights arising from the reservation of ownership. The assertion of the reservation of ownership does not constitute a withdrawal from the contract unless we have expressly declared the termination of the contract.
For business customers, the following provisions also apply: We retain ownership of the goods until the complete settlement of all claims arising from an ongoing business relationship.
6. PRICING
All prices listed on the online store are in Euros (see the catalog of products and prices here: https://www.y-brush.com/acheter). They include VAT for mainland France* and European Union countries, excluding DOM-TOM. Customers outside mainland France and the European Union, excluding DOM-TOM, may therefore be subject to additional fees and/or taxes upon arrival.
Prices do not include shipping costs.
All prices on the www.y-brush.com site are firm and final. Y-Brush (Fasteesh company) reserves the right to modify the prices of products at any time, but the products will be charged based on the rates in effect at the time the orders are taken into account for non-subscription products.
For subscription products, the Company reserves the right to change product prices at any time, in accordance with applicable legislation.
The amount of shipping fees is determined based on the destination country. This will be shown at the time of payment before the validation step.
Our rates do not account for any potential customs fees, which are the responsibility of the customer.
*The applicable VAT rate is set at 20%.
7. ORDER CANCELLATION AND WITHDRAWAL
7.1 CANCELLATION OF ORDER BEFORE RECEIPT OF GOODS AND REFUSAL OF DELIVERY
If you wish to cancel an order before taking possession of it, generally at its reception, delivery fees will then be charged to you or deducted from the refund if the order has already left our warehouse.
In case of delivery refusal, meaning you refuse the delivery when the carrier presents it to you or contacts you, the fees charged to us by the carrier(s) (return transport, customs fees, VAT, etc.) will be re-invoiced to you or deducted from the refund amount.
7.2 SATISFACTION GUARANTEED OR 100% REFUNDED
Y-Brush commits to offering its customers a "Satisfaction Guaranteed or 100% Refunded" warranty for toothbrushes purchased on our website, subject to the terms and conditions set out below. Some products are not covered by the program, this is specified on the product sheet (example: as part of a big sale).
7.2.1 Eligibility for the Guarantee
This guarantee is only applicable to Y-Brush toothbrushes purchased directly from the Y-Brush website (hereinafter referred to as "the Site"). Products purchased from third-party retailers or distributors are not covered by this guarantee, except during special promotional operations governed under dedicated promotional conditions.
To be eligible for this guarantee, the purchaser must meet the following conditions:
The purchaser must have bought the product directly from the site.
The purchaser must return the product in its original packaging, in perfect condition (any damaged, incomplete, or deteriorated products or products with damaged packaging will not be accepted).
The refund request must be submitted within 30 days from the date of delivery of the product to their home or to a collection point.
7.2.2 Refund Request Procedure
To request a refund under this warranty, the purchaser must contact Y-Brush customer service at customers@y-brush.com
The purchaser will need to provide proof of purchase or their order number, and a detailed explanation of why they are not satisfied with the product.
Once the request is validated, the purchaser can proceed with the return, at their own expense. The refund will occur within a maximum of two weeks after the receipt of the products, minus the shipping costs.
Note: In the case of a subscription order involving regular delivery of products over a defined period, the withdrawal period starts from the receipt of the first product.
8. TRANSPORT DAMAGES
8.1 FOR CONSUMERS THE FOLLOWING PROVISIONS APPLY:
You have a period of 48 hours, upon receipt of your order, to report any issues to Fasteesh regarding a missing product in the delivery box or any packaging problems. Once a package is delivered, you have the option, at the time of signing, to make reservations about the state of it. Beyond this point, we decline any responsibility for the condition of the delivered package.
If the delivered goods have been obviously damaged during transport, please contact us immediately.
8.2 FOR BUSINESS CUSTOMERS, THE FOLLOWING PROVISIONS APPLY:
The risk of loss or accidental deterioration is transferred to you as soon as we have handed over the item to the forwarder, carrier, or the individual or entity responsible for the shipment. Business customers are subject to the duty to inspect and report defects. If you fail to do so, the goods are considered approved, unless it concerns defects that could not be detected during the inspection. This does not apply if we have fraudulently concealed a defect.
9. RETURNS
Returns of merchandise are only accepted under the legal warranty or the exercise of your right of withdrawal (14 days from the receipt of the package).
As far as possible, the merchandise should be returned undamaged, uncontaminated and complete with all accessories and in its original packaging. If you are not able to return the merchandise in its original packaging, please provide suitable packaging to ensure protection of the merchandise during transport to avoid claims for damages due to defective packaging.
9.1 RETURN COSTS
Return costs are borne by the consumer.
If a customer, contacted by our delivery service, is not at home, does not receive their package, or does not claim it within 48 hours, the package will be returned to us. The cost of re-sending the order from our facilities will therefore be charged to the customer.
10. WARRANTY
10.1 LEGAL WARRANTY
According to Article L217-7 of the Consumer Code, all consumers have a legal warranty of two years. This warranty applies to defects present at the time of delivery of the product.
This warranty only covers conformity defects. Any defect resulting from improper use (e.g., water inside the motor block) or normal wear and tear will not be covered by the warranty, nor will any product that has been repaired by unauthorized persons without Y-Brush's agreement.

10.2 LIFETIME WARRANTY FOR SUBSCRIBED CLIENTS
The lifetime warranty applies to customers who subscribe to the brush head delivery with a minimum of 2 brush heads per year. To be eligible for the lifetime warranty, the customer must keep their subscription active and not miss any payments.
Warranty exclusion: If the customer cancels their subscription, the lifetime warranty no longer applies. Any defect resulting from improper use (e.g., water inside the motor block) or normal wear and tear will not be covered by the warranty, nor will any product that has been repaired by unauthorized persons without Y-Brush's agreement.
Warranty terms: The lifetime warranty covers any manufacturing or material defects in the products delivered as part of the subscription. If a product is defective, the customer must contact the seller as soon as possible to report the issue. The seller may require the customer to return the defective product for inspection. If the product is indeed defective, the seller will proceed with its replacement or refund, in accordance with the terms set out in these GTC.

11. LIABILITY
The products offered comply with current French legislation. The liability of the company FasTeesH cannot be held accountable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you intend to order.
Furthermore, the company FasTeesH cannot be held liable for damages resulting from improper use of the purchased product.
12. DISPUTE RESOLUTION
The GTC are subject to French law.
In case of any difficulty, our Customer Service is available to find an amicable solution. This Customer Service can be reached by email at customers@y-brush.com or in the "Contact Us" section.
In the absence of a solution found directly with the Customer Service, and in accordance with the provisions of the Consumer Code, Fasteesh adheres to the CM2C Mediation Service (Centre de la Médiation de la Consommation de Conciliateurs de Justice) whose details are as follows: CM2C - 14 rue Saint Jean - 75017 Paris - https://cm2c.net/. After prior written steps on your part, the Mediation Service may be seized for any consumer dispute that has not been successfully resolved.
The Client is also informed that the European Commission has established a platform for online dispute resolution to collect any complaints following an online purchase. The platform then forwards these complaints to a competent national mediator. You can access this platform by following this link: http://ec.europa.eu/consumers/odr/.
In the absence of an amicable settlement, jurisdiction is given to the competent French courts, notwithstanding multiple defendants or a guarantee call.
